Reconstructing Contemporary Fiqh: Gender-Responsive Ijtihad by the Indonesian Women Ulema Congress (KUPI)

The Congress of Indonesian Women Ulama (KUPI) represents a significant development in bringing gender equality principles into Indonesian Islamic legal discussions. Beyond demonstrating female leadership within theological scholarship, the Congress provides methodologies for addressing gender-based discrimination that frequently gains legitimacy through particular readings of Islamic jurisprudence. The research examines how KUPI advances gender equality frameworks using a contextual methodology grounded in maqâshid al-sharîa. Employing a qualitative phenomenological methodology, the investigation gathered information via document examination, observational participation, and comprehensive interviews with key KUPI representatives. The analytical framework incorporated a critical examination of patriarchal social systems alongside a hermeneutic interpretation of sacred texts. Findings reveal that KUPI champions three strategic pathways for advancing gender equality: (1) gender-sensitive reinterpretation of Islamic jurisprudence; (2) grassroots community engagement; and (3) expansion of scholarly networks among ulama. The research demonstrates that KUPI serves a critical function in establishing a more equitable Islamic legal framework that maintains its foundation in Islamic heritage while simultaneously aligning with human rights standards.
